This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.403 of 2022, pending in the file of learned S.D.J.M., Udala, arising out of Kaptipada P.S. Case No.126 of 2022, for offences under Sections 341/323/376 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional District & Sessions Judge, Baripada, by order dated 24.06.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

It is submitted that since charge-sheet has already been filed and the petitioner is in custody from 08.05.2022, further continuance of the petitioner in custody is not warranted. 7.

Taking note of the tenor of the 164 Cr.P.C. statement and filing of charge-sheet as stated, this Court directs the petitioner to

be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
