Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Spl.(POCSO) Case No. 28 of 2022 arising out of Jajpur Road P.S. Case No. 173 of 2022, pending on the file of the learned Addl. District & Sessions Judge-cum-Special Court under POCSO Act, Jajpur for the alleged commission of offence under Sections 363/366/376(2)(n)/323/294/506 of the I.P.C. and Sec.6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. District & Sessions Judge-cum-Special Court under POCSO Act, Jajpur, by Order dtd.21.07.2022, the present BLAPL has been filed. 5.
Perused the 164, Cr.P.C. Statement of the victim.

Taking into account the tenor thereof and the Chargesheet has already been filed on 30.6.2022 and the petitioner is in custody since 7.04.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.
