Heard learned counsel for the parties.

The petitioner is an accused in connection with Spl. G.R. Case No. 20 of 2022 arising out of Ppanikoili P.S. Case No. 62 of 2022, pending on the file of the learned Addl. Sessions Judge-cum-Special Judge, Jajpur Road for the alleged commission of offence under Sections 294/323/427/506/324/302/201 of the I.P.C. and Sections 3(1) (r)(s)/3(2)(va) of the S.C. & S.T. (PoA) Act and Section 14 of the Child Labour (Prohibition and Regulation ) Act, 1986. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judgecum-Special Judge, Jajpur Road, by Order dtd.10.05.2022, the present BLAPL has been filed.

Perused the Charge-sheet filed on 10.06.2022. 6.

It is submitted by the learned counsel for the petitioner that though, F.I.R. was instituted inter alia under Section 302 of the I.P.C. and other allied offences and Sections 3(1)(r)(s)/ 3(2)(va) of the S.C. & S.T. (PoA) Act and Section 14 of the Child Labour (Prohibition and Regulation ) Act, 1986, the Charge-sheet has been filed under section 294/323/427/506/341 of the I.P.C. and Section 14 of the Child Labour (Prohibition and Regulation ) Act, 1986 7.

Basing on the recitals in the Charge-sheet placed on record and the opinion of the doctors of SCB Medical College and Hospital, Cuttack, that the probable cause of death is acute Pancreatitis in shock and the death of the decease is due to "natural disease", this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.
