This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Spl. G.R. Case No.16 of 2022, pending on the file of the learned ADJ-cum-Special Court under (POCSO) Act, Cuttack, arising out of Banki P.S. Case No.34 of 2022, offences under Sections 376(2)(a)/376(3) of IPC read with Section 6 of (POCSO) Act and is in custody since 08.02.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, by order dated 24.06.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C statement and the medical examination report.

Taking note of 164 Cr.P.C. statement and filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
