1. This matter is taken up in the 1st National Lok Adalat in presence of the Advocates/representatives of both the AppellantInsurance Company and Respondent No.1-claimant through Hybrid Mode.
2. On the basis of the compromise made between the parties, the compensation amount is modified and reduced to a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand) along with interest @6% per annum from the date of filing of the claim application.
3. The Insurance Company is directed to deposit the modified award amount before the learned Tribunal within a period of two months which shall be disbursed to the claimant on such terms and proportion to be decided by the Tribunal. The right of recovery granted by the learned Tribunal is left undisturbed.
4. On deposit of the modified award amount before the learned Tribunal and filing of a receipt evincing the deposit before this Court with a refund application, the statutory deposit made before this Court with accrued interest thereon shall be refunded to the Appellant-Insurance Company.
5. The appeal is disposed of.
6. The appeal having been disposed of in the Lok Adalat, no Court fee is payable.
