This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

The Petitioners are accused in connection with C.T. Case No.122 of 2022 arising out of Koksara P.S. Case No. 106 of 2022 pending on the file of learned JMFC, Koksara, registered for the alleged commission of offence under Sections 399/402 of the I.P.C. 4.
Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Dharamgarh by order dated 19.07.2022, the present BLAPL has been filed. 5.
Learned counsel for the petitioner submits that petitioner has no criminal proclivity.

Taking into account the nature of allegation and keeping in view the filing of Charge-sheet on 24.06.2022, this Court directs that the petitioners shall be released on bail on such terms to be fixed by the learned court in seisin over the matter.

While so releasing the learned court in seisin over the matter to check the veracity of the submission of the learned counsel for the petitioners regarding the criminal proclivity. If it comes to the fore that the petitioners have any criminal proclivity, the present order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
