I.A. No. 140 of 2016 & CMAPL No. 309 of 2022 This matter is taken up through hybrid mode.

This I.A. has been filed for condonation of delay in filing the CMAPL and the CMAPL has been filed for recalling of the order dated 31.08.2021 passed in WPC (OAC) No. 456 of 2016. 3.

Since there is a delay of 300 days in filing the CMAPL, in view of the decision of this Court in the case of State of Odisha and another v. Smt. Bishnupriya Routray and another, 118 (2014) CLT 588, this Court is not inclined to condone the delay in filing the CMAPL.

In view of the above, the I.A. stands dismissed and as a consequence therefore, the CMAPL stands dismissed. Arun (DR. B.R. SARANGI) JUDGE
