CORAM:
JUSTICE K.R. MOHAPATRA
ORDER
Order No.
29.09.2022 3.
1.
This matter is taken up through hybrid mode.
2.
None appears for the Petitioners at the time of call. 3.
Petitioners in this CMP seek to assail the order dated 27th June, 2022 (Annexure-5) passed by learned Civil Judge (Junior Division), Kendrapara in IA No.367 of 2016 (arising out of CS No.464 of 1990) allowing an application filed by Opposite Parties under Order IX Rule 13 CPC.
3.1 On 8th August, 2022 the matter was adjourned on the prayer of learned counsel for the Petitioners. On 12th September, 2022, learned counsel for the Petitioners prayed for an adjournment to verify whether the order impugned herein is revisable. Today, none appears for the Petitioners to pursue the CMP. Hence, it appears that the Petitioners have lost interest to pursue the CMP.
4.
Accordingly, the CMP stands dismissed for nonprosecution. (K.R. Mohapatra) Judge s.s.satapathy
