Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. (S) Case No. 13 of 2015 arising out of Chendipada P.S. Case No. 155 of 2014, pending on the file of the learned Addl. Sessions Judge, Angul for the alleged commission of offence under Sections 498-A/304-B/306/34 of the I.P.C. read with Section 4 of the D.P.Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Angul, by Order dated 08.07.2022, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that non appearance before the learned trial court on the date fixed, in terms of the direction passed by this
Court dated 28.11.2017 in BLAPL No. 8198 of 2017 was due to unavoidable circumstances. Hence, the release of the petitioner is prayed for.

Taking into account the release of the petitioner on earlier occasion in terms of the order of this Court, it is directed that the petitioner shall be released on bail on such terms to be fixed by the learned Court in seisin over the matter so as to ensure his presence on each date of trial.

Additionally it is directed that one of the sureties shall be the immediate family member of the petitioneraccused. 8.
The BLAPL thus stands disposed of.
