This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in Special G.R. Case No.57 of 2022 pending in the file of learned Addl. Sessions Judge-cumPOCSO Court, Cuttack, arising out of Baranga P.S. Case No.20 of 2022, for offence under Sections 365/109 IPC and Section 17 of the POCSO Act and is in custody since 29.06.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Special Court under POCSO Act, Cuttack by order dated 25.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the statement of the victim recorded under Section 164 Cr.P.C. which is on record.

Considering the role ascribed by the Petitioner and filing of the charge sheet on 4.7.2022 and the principal accused, namely, Sumanta Rout, who is not the Petitioner in this bail application, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
