The present contempt has been filed by the petitioner for the alleged willful disobedience of the order dated 09.09.2021 passed by the Division Bench of this Court directing the Bank to take a sympathetic view while considering the OTS proposal of the petitioner for an amicable settlement of the outstanding dues.

At the time of hearing, Mr. Mishra, learned counsel for the Bank submits that the aforesaid order dated 09.09.2021 was duly complied and the OTS proposal was considered in terms and conditions of the prevailing policy of the Bank and rejected on 06.07.2022. He further states that even otherwise the present contempt is infructuous as upon deposits of the
// 2 // amounts overdue, the loan account stands upgraded to a standard account.

In view of the above, no further action is to be taken.

Accordingly, the contempt proceedings are dropped.
