This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned Standing Counsel for the Vigilance.

The Petitioner is an accused in V.G.R. Case No.16 of 2019 pending in the file of learned Special Judge (Vigilance), Cuttack, arising out of Cuttack Vigilance P.S Case No.19 of 2019 for offence under Sections 13(2) and Section 13(1)(c)(d) of the P.C Act and Sections 409/477-A/120-B IPC and is in custody since 09.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Vigilance, Cuttack by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It appears from the rejection order that the amount involved i.e. Rs.34,65,237/- has since been received back in the Government Treasury.

Taking into account the period of custody and the progress in investigation, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
