Heard Mr. B.K. Behera, learned counsel for the petitioner and Mr. A.K. Nanda, learned Additional Government Advocate. On oral prayer, Mr. Behera is permitted to correct the description of opposite party No.2 in the cause title in Court today.

According to Mr. Behera, though initially on account of pendency of R.S.A. No.212 of 2005 before this Court, the petitioner was denied benefit of compensation for the land of hers which has been acquired for construction of National Highway No.5. Now after pronouncement of judgment in the above noted second appeal though the petitioner has approached the Land Acquisition Officer-cum-Competent Authority, National Highway Authority of India, at Chatrapur in the district of Ganjam (opposite party No.3) by filing a representation on 04.07.2022 under Annexure-8 series enclosing a copy of the judgment date 20.06.2022 rendered by this Court in R.S.A. No.212 of 2005 however, till date, no final
// 2 // decision has been taken by the said opposite party in the matter of awarding of compensation to the present petitioner. Accordingly, he prays that a direction be issued to opposite party No.3 to take a decision on the representation of the petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the opposite party No.3 to take a decision on the above noted representation of the petitioner dated 04.07.2022 under Annexure-8 series in accordance with law within a period of three months from the date of receipt of a certified copy of this order after giving opportunity of hearing to the petitioner as well as Srimati Nagireddy Kumari, W/o N. Purusottam Reddy, resident of Daya Mohanty Tank Road, Berhampur-2, Dist: Ganjam and Samuel Victor Das, S/o Daniel Victor Das, resident of Bejipur Tank Road, Berhampur-1, Dist: Ganjam, who were parties in the concerned civil litigation and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 5.
Urgent certified copy of this order be granted on proper application in course of the day.
