This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction for early disposal of C.P. No.147 of 2017 pending before learned Judge, Family Court, Khurda.

Mr. Jena, learned counsel for the Petitioner submits that the evidence from the side of the present Petitioner was closed on 5th February, 2022 and since then, the Opposite Party-Wife is taking adjournment on several dates to adduce evidence on her behalf. The matter was posted to 13th July, 2022 on which date also the Respondent-Opposite Party remained absent for which the matter was adjourned to 24th July, 2022 for hearing/adducing evidence from the side of from the Respondent as a last chance. He further submits that even thereafter the Respondent-Opposite Party is not cooperating for early disposal of the civil proceeding for which the Petitioner is seriously prejudiced. He, therefore, prays for a direction for the aforesaid relief.

Taking into consideration the submission of learned counsel for the Petitioner and on perusal of the record more particularly the order sheet of C.P. No.147 of 2017 annexed to the writ petition as Annexure-6, it appears that since 26th March, 2022, the RespondentOpposite Party is not cooperating with learned Judge, Family Court, Khurda for early disposal of the civil proceeding. This writ petition is, therefore, disposed of with a direction that in the event the Respondent-Opposite Party does not cooperate with learned Judge, Family Court, Khurda for early disposal of C.P. No.147 of 2017, he shall do well to proceed with the matter in accordance with law and see that C.P. No. 147 of 2017 is disposed of by the end of October, 2022.
Urgent certified copy of this order be granted on proper application.
