This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and the learned counsel for the State.

The Petitioner is an accused in G.R Case No.45 of 2020 (N) pending on the file of learned 1st Addl. Sessions Judge-cumSpecial Judge, Berhampur, arising out of Badabazar P.S. Case No.245 of 2020 for commission of offence under Section 20(b)(ii)(C)/25 of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Addl. Sessions Judge-cumSpecial Judge, Berhampur by order dated 19.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Since the trial has already commenced and keeping in view the criminal antecedents of the Petitioner, this Court is not inclined to entertain this bail application at this stage.

Taking into account the Petitioner is in custody since 30.11.2020, learned Court in seisin over the matter is called upon to expedite the trial of the aforesaid case and conclude the same within the period of three months from the date of receipt/production of the copy of this order.

In the event the trial is not conclude within the time stipulated, it shall be open to the Petitioner to renew his prayer before the learned Court in seisin over the matter, which shall be considered on its own merit without being influenced by the earlier rejection or the order passed by this Court.

Registry is requested to communicate this order to the learned Court in seisin over the matter.

With the aforesaid order, this BLAPL stands disposed of. 10.
