This writ petition has been filed challenging the order passed by the appellate authority in mutation manual challenging an order to refuse to entertain the mutation appeal on the ground of delay for 13 years. 3.
Considering the ground of challenge in the appeal, this Court finds the appellate authority in mutation manual has no such jurisdiction. It is at this stage of the matter, learned counsel appearing for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to avail the other remedy available for the purpose. Consequently, the writ petition stands dismissed as withdrawn but however with liberty as prayed for.
