This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the appellant and learned counsel for the State. Perused the F.I.R., Case Diary and other relevant documents.

This is an application under Section 14-A of the S.C. and S.T. (P.A.) Act.

The appellant is an accused in T.R. No.94 of 2021(Spl. G.R. No.45 of 2021) arising out of Puri Sadar P.S. Case No.106 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Puri for commission of offence punishable under Sections 341/323/354/294/506/394/302/34, I.P.C.

read with Section 3(1)(r)(s)/2(va) of the S.C. and S.T. (P.A.) Act. 5.

Learned counsel for the appellant seeks permission to withdraw the present appeal with liberty to move a fresh bail

// 2 // application before the court below in the event the trial is not concluded within a stipulated time.

Considering the submissions and the materials available on record, the appellant is permitted to withdraw the bail application and the same is accordingly disposed of as withdrawn. 7.

However, learned trial court shall make endeavour to dispose of the case as expeditiously as possible preferably within a period of four months from today without being influenced by any other factors.

It is further directed that in the event the trial court fails to conclude the trial within the aforesaid period of time, the appellant is given liberty to file a fresh bail application. 9.

With the aforesaid observation, the CRLA stands disposed of. Urgent certified copy of this order be granted on proper application.
