This application has been filed to recall the order dated 15.07.2021 passed in WPC (OAC) No. 737 of 2005 by which the writ petition was dismissed since learned counsel for the petitioner contended that he has no instruction in this matter.

Mr. S. Mohanty, learned counsel for the petitioner contended he had entered appearance on behalf of the petitioner obtaining consent from the previous counsel, but when the matter was taken up, he could not appear on the date fixed. Therefore, he prays for recall of the order dated 15.07.2021 passed in WPC (OAC) No. 737 of 2005.

Mr. S. Rath, learned Additional Standing Counsel has no objection to the above prayer of learned counsel for the petitioner. 5.

In view of the above, on the consent of learned counsel for the parties, the order dated 15.07.2021 passed in WPC (OAC) No. 737 of 2005 is recalled and the writ petition is restored to its file. 6.

The CMAPL is accordingly disposed of.
