This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Choudwar P.S. Case No.175 of 2022 corresponding to G.R. Case No.913 of 2022, pending before the learned J.M.F.C., Rural Cuttack, under section379 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Cuttack, by order dated 21.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Considering the nature of allegation and the punishment prescribed and taking into account that the petitioner has been remanded in the case at hand on 01.05.2022 , this Court directs the

petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter, including that 7.

Additionally it is directed that one of the sureties shall be immediate member of the family and the petitioner shall appear before the jurisdictional police station once every week till submission of final form.

Accordingly, the BLAPL stands disposed of.
