This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. (Special) Case No.37 of 2022 arising out of Barpali P.S. Case No.185 of 2022, pending in the file of learned District & Sessions Judge, Bargarh, under Section 21(b)/25/29 of NDPS Act and is in custody since 12.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Bargarh by order dated 17.03.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the rejection order.

Learned counsel for the petitioner submit that the coaccused persons have been released on bail by this Court by order
dated 04.08.2022 in BLAPL No.6879 of 2022 and order dated 17.08.2022 in BLAPL No.7153 of 2022.

Taking into account the nature of allegation and the petitioner being in custody since 12.06.2022 and release of the coaccused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once in every week till the submission of the charge sheet. Violation of such appearance shall entail cancellation of bail.

Accordingly, the BLAPL stands disposed of.
