This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.33 of 2021, arising out of Puruna Katak P.S. Case No.28 of 2021 pending in the court of learned J.M.F.C., Harbhanga at Charichhak in the district of Boudh for commission of offence punishable under Sections 409/420/506, I.P.C. 5.
It is submitted by learned counsel for the petitioner that the petitioner is an employee of L & T Finance Pvt. Ltd. A complaint has been lodged against the petitioner alleging that the petitioner has misappropriated money to the tune of Rs.31,550/- (rupees thirty one thousand five hundred fifty) recovered from the present petitioner. // 2 // such context, learned counsel for the petitioner further submits that the petitioner has not yet been received his salary amounting to Rs.27,000/-(rupees twenty seven thousand) 6.
Considering the nature of allegation, gravity of offence and the facts of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrender before the learned court in seisin over the matter within a period of three weeks from today, he shall be released on bail on such terms and conditions as would be deemed just and proper subject to condition that he shall furnish cash security of Rs.31,550/- (rupees thirty one thousand five hundred fifty) besides other conditions would be imposed by the learned court below while releasing the petitioner on bail.

Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
