This is an application for amendment of the CMP. 2.

Counter Affidavit on behalf of Opposite Party Nos.2 to 4 filed in Court is taken on record.

Petitioner in this writ petition seeks for a direction to set aside the demand notice under Annexure-2 series and also the action taken by Opposite Parties in disconnecting power supply to his premises.

Mr. Dash, learned counsel for TPCODL by filing counter affidavit submits that pursuant to the provisional assessment under Annexure-2 series, the Petitioner has already submitted his show cause on 26th July, 2022 under Annexure-5. However, the final assessment is awaited. He, however, submits that steps are being taken to make final assessment very shortly. 5.

Mr. Mohanty, learned counsel for the Petitioner submits that power connection to the premises of the Petitioner is

// 2 // disconnected for which he suffering a lot. Hence, he prays that during pendency of the assessment proceeding, power supply to the premises of the Petitioner may be restored. 6.

Upon hearing learned counsel for the parties and on perusal of record, this Court finds provisional assessment amount as per Annexure-5 is Rs.46,06,132. In view of the above, it is directed that on payment of Rs.15.00 (rupees fifteen lakh only) within seven days hence and on compliance of formalities, power supply to the premises of the Petitioner shall be restored, which shall be subject to the order to be passed by the Assessing Officer in the assessment proceeding. Needless to observe that the Petitioner shall go on paying the current bills. 7.

With the aforesaid observation and direction, the writ petition stands disposed of.

Issue urgent certified copy of the order on proper application.
