This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.823 of 2022, on the files of S.D.J.M. Dhenkanal, arising out of Motanga P.S. Case No.145 of 2022, under Sections 498(A)/304(B)/302 and 34 of IPC and is in custody since 25.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned A.D.J.-cum-Special Judge, (Vigilance), Dhenkanal, by order dated 26.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that though the FIR was instituted inter alia under Section 302 of IPC, after investigation charge sheet has been filed under Section 306/498-A/34 of IPC.

Considering the period of custody and filing of charge sheet as aforesaid and the role ascribed to the present petitioner, being the father-in-law and keeping in view his age, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
