This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.149 of 2022, on the files of S.D.J.M. Birmaharajpur, arising out of Ullunda P.S. Case No.58 of 2022, under Sections 376(2)(n) and 376(1) of IPC and is in custody since 31.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Sonepur, by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.
Considering that the charge sheet has already been filed on 26.05.2022 and taking into account the nature of allegations being
made, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
