This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Name of Mr. M. Padhy, learned counsel be deleted and in his place, name of Mr. S. Mitra, learned counsel for the petitioner be reflected in terms of the prisoners petition at flag M. 4.

The petitioners are an accused in connection with 2(a) CC Case No.26 of 2021, pending in the file of learned Sessions Judgecum-Special Judge, Cuttack, arising out of P.R. Case No.13 of 2021, for alleged commission of offences under Sections 20(b)(ii)(C) of N.D.P.S. Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Cuttack, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

This is the 3rd journey of the petitioner to this Court.

Initially the petitioner has preferred BLAPL No.4298 of 2021 which was withdrawn as per order dated 18.06.2021 of this Court passed by Co-ordinate Bench.

The present petitioner was one of the four petitioners who approached this Court in BLAPL No.4104 of 2021. On consideration of materials on record, this Court by order dated 19.04.2021, disposed of the bail application so far as the present petitioner, who was the petitioner No.1 in BLAPL No.4104 of 2021 as not pressed, while granting bail to other three petitioners-coaccused. 9.

In the present bail application, the petitioner is seeking release on bail inter alia on the ground of parity. 10.

Learned counsel for the State opposes the prayer for bail. 11.

On consideration of materials on record, since there is no change in circumstances, this Court is not inclined to entertain the bail application.

Accordingly, the BLAPL stands disposed of.
