Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 549 of 2022 arising out of Khordha Model P.S. Case No. 170 of 2022, pending on the file of the learned SDJM, Khordha for the alleged commission of offence under Sections 307/326/34 of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned 1st Addl. Sessions Judge, Khurda, by Order dtd.27.07.2022, the present BLAPL has been filed.

Placing reliance on the order passed by this Court dated 20.05.2022 in BLAPL No. 4447 of 2022 relating to one Manoj Kumar Sahoo, it is submitted by learned counsel for the petitioner that the overt act is attributed to him and since
he has been directed to be released on bail, seeks release of the petitioner inter alia on the ground of parity. It is further submitted that the injured has recovered in the meanwhile. 6.
Learned counsel for State on the basis of recitals in the Case Diary with his usual fairness does not dispute that the overt act is attributed to the petitioner since released on bail 7.
Taking note of the above submission at the Bar, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter so as to ensure his presence on each date of trial. 8.
The BLAPL thus stands disposed of.
