This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 1267 of 2022 arising out of Gosaninuagaon P.S. Case No. 95 of 2022, pending on the file of the learned SDJM, Berhampur for the alleged commission of offence under Sections 341/323/325/364/506/34 of the I.P.C. and Section 25(1-B) of the Arms Act.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Ganjam, Berhampur, by Order dtd.27.07.2022, the present BLAPL has been filed.

Considering the release of the co-accused persons, namely, Mohammed Amin and Mohammed Sanif by order of

this Court dated 08.08.202 in ABLAPL No. 9410 of 2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional Police Station once every week till submission of the Final Form. Certification of such appearance shall be submitted to the learned court in seisin over the matter. Criminal proclivity of the petitioner shall be verified at the time of release of the petitioner on bail. If it comes to the fore that the petitioner has any antecedent the present order shall stands recalled.

The BLAPL thus stands disposed of.
