This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Rayagada P.S. Case No. 191 of 2021 corresponding to G.R. Case No. 414 of 2021, pending on the file of the learned SDJM, RAyagada for commission of the alleged offence under Sections 302/201/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned District and Sessions Judge, Rayagada by order dated 29.06.2022, the present BLAPL has been filed.

Learned counsel for the State submits that the basis of implication is on account of statements of the eyewitnesses. 6.
On perusal of the rejection order it is seen that trial has commenced. Hence, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands rejected.
8.
Learned court in seisin over the matter is requested to conclude the trial within a period of three months from the date of receipt/production of certified copy of this order. 9.
In the event the trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer.
