This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.254 of 2021 committed to S.T. Case No.107 of 2022, pending in the Court of learned 3rd Additional Sessions Judge, Berhampur arising out of Pattapur P.S. Case No.267 of 2021 for alleged commission of 395/398/120-B of IPC read with Section 25(1-B)(a)/27 of Arms Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 3rd Additional Sessions Judge, Berhampur by order dated 18.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the co-accused persons similarly circumstanced have since been released on bail by this Court by
order dated 11.03.2022 in BLAPL No.10096 of 2021 and order dated 17.03.2022 in BLAPL No.10261 of 2021 and order dated 10.03.2022 in BLAPL No.10094 of 2021. Hence learned counsel for the petitioner seeks release of the petitioner. 6.
Learned counsel for the State opposes the prayer for bail. 7.
Taking into account the submissions of the learned counsel for the petitioner and considering the release of the coaccused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view criminal proclivity of the petitioner this Court directs the petitioner to appear before the jurisdictional police station once every week till the conclusion of trial. 9.
Accordingly, the BLAPL stands disposed of.
