1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the Petitioners who are teaching and non-teaching staff of Gram Panchayat High School, Tendabadi, in the district of Nayagarh, seek a direction from this Court to the Opposite Parties more particularly the Opposite Party No.1/ Principal Secretary, School and Mass Education Department, Government of Odisha, Bhubaneswar to take over their school and declare them as Government servants as they have met all the

// 2 // requirements for taking over the school by the Government.

4. Learned counsel for the Petitioners submits that though similarly situated aided schools were taken over by the Government, the Petitioners' school has been excluded arbitrarily. He further submits that though the Managing Committee has no right to claim such relief against the Department, but taking over of the similarly situated schools by the Government makes their cases stronger. It is also submitted that the Petitioners have filed a representation before the Opposite Party No.1/ Principal Secretary, School and Mass Education Department, Government of Odisha, Bhubaneswar ventilating their grievance. But the same is pending before the authority since 27.05.2022.

5. In such view of the matter, the Opposite Party No.1/ Principal Secretary, School and Mass Education Department, Government of Odisha, Bhubaneswar to dispose of the representation of the Petitioners with a reasoned order within a period of one month from the date of submission/ production of a copy of this order.

6. Accordingly, this Writ Petition is disposed of.
