This matter is taken up through hybrid mode.

Learned counsel for the petitioner has filed a memo in Court today stating therein that after submission of charge-sheet the case has been committed to the Court of learned District & Sessions Judge, Sundargarh which is registered as S.T. Case No.74 of 2022. 3.

Heard learned Senior Counsel for the petitioner and learned Additional Standing Counsel for the State. 4.

The petitioner is an accused in connection with S.T. Case No.74 of 2022, pending in the Court of learned District & Sessions Judge, Sundargarh, arising out of Kinjirikela P.S. Case No.64 of 2022, for commission of offences under Sections 417/493/312 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sundargarh, by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 7.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 04.05.2022 and as charge-sheet has already been filed on 28.06.2022, further continuance of the petitioner in custody is unwarranted.

Considering the tenor thereof and taking into account the nature of allegations and filing of charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned District & Sessions Judge, Sundargarh in S.T. Case No.74 of 2022.

Accordingly, the BLAPL stands disposed of.
