Heard Mr. S.C. Dash, learned Counsel for the Petitioner. 3.
The Petitioner has filed this Writ Petition challenging rescission of the contract, vide order dated 23.02.2015, on the ground that the Petitioner has not completed the work within the time specified. 4.
Mr. S.K. Dash, learned counsel for the Petitioner contended that the Petitioner was willing to complete the work within the time specified, but due to the problem created by the authorities, the same could not be done within the time specified. He further contended that after rescission of the contract, the Opposite Parties may impose penalty or ask for compensation for not completing the work within the time specified.

It appears that no such step has been taken by the Opposite Parties, nor any document is placed on record in regard to the same. It is
only the apprehension of the Petitioner and, as such, the Writ Petition is premature. So far as refund of security deposit is concerned, it is open to the Petitioner to pursue his remedy in terms of the DTCN/ Agreement, which is applicable to him.
