This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Hemagiri P.S. Case No.85 of 2021, corresponding to Spl. G.R. Case No.48 of 2021 pending in the file of learned Additional District Judge-cum-Special Court under POCSO Act, Sundargarh, for commission of alleged offences under Sections 376(2)(n)/313 of I.P.C. r/w. Section 6 of POCSO Act. 3.

Heard learned counsel for the Petitioner, learned counsel for the State and the victim girl in person through Video Conferencing mode, who was presented before this Court by the IIC, Hemgir. Perused the case records.

During course of hearing, learned counsel for the Petitioner seeks leave to withdraw the bail application with liberty to move the court below afresh after examination of the victim girl

In such view of the matter, the bail application is disposed of as withdrawn. However, this Court directs that the trial court to make an endeavor to expedite the trial of the aforesaid case and conclude the same preferably within a period of six months from the date of this order.

With the above direction, the BLAPL stands disposed of with liberty as prayed for.
