This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 120-B/420/467/468/471, I.P.C.

Learned counsel for the Petitioner submits that the Petitioner has not been named in the F.I.R. and the entire allegation is against the principal accused namely one Maitreya Mishra, who had availed the vehicle loans by committing forgery. So far as the present Petitioner is concerned, it is stated by learned counsel for the Petitioner that the Petitioner has purchased one Alto car from one of the lonees namely Pritam Kumar Das.

Considering the aforesaid facts and submission and the nature of allegation, I am inclined to grant anticipatory bail to the Petitioner. Therefore, it is directed that, in the event of arrest, the Petitioner shall be released on bail by the Arresting Officer in connection with EOW, Bhubaneswar P.S. Case No.10 of 2018 corresponding to C.T. Case No.1789 of 2018 pending in the Court of learned S.D.J.M., Bhubaneswar, on such terms and conditions as would be deemed just and proper, subject to the condition that the Petitioner shall cooperate with the investigation and shall appear before the I.O. as and when required for the purpose of investigation. 6.

The ABLAPL is disposed of accordingly.
