Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "(i) Writ of Mandamus directing the opposite parties to resume the duties of the petitioner as Nursing Officer under opp.

parties No.4 and 5 at her actual place of posting i.e., Kalimela CHC, Kandhamal without compelling her to take NPA training by declaring the order dated 02.05.2022 under Annexure-5, dtd.09.12.2021 under Annexure-6 and relieving order dtd.11.05.2022 under Annexure-7 as bad in law and liable to be quashed.

(ii) Release the salary and other service benefits from the relived dated 11.05.2022 to till the rejoining period".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opposite Party No.2 by enclosing all the relevant

// 2 // documents and citations in support of his claim, if any, within a period of one week hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.2 shall do well to dispose of the representation within a period of one month taking into account the recommendation made by the C.D.M.O., Malkangiri under Annexure-9. The decision so taken by the Opposite Party No.2 be communicated to the Petitioner within that time. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
