This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Balianta Excise P.R.No. 30/2022-23 corresponding to T.R. No. 271 of o2022, pending on the file of learned District & Sessions Judge, Khurda, under Sections 20(b)(ii)(B) of N.D.P.S. Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Khurda at Bhubaneswar by order dated 27.07.2022, the present BLAPL has been filed. The petitioner is stated to be in custody 14.07.2022. 5.

Perused the order of rejection.

Considering the quantity of contraband seized to the tune of 5.110 Kgs contraband (Ganja), which is admittedly less than commercial quantity and the period of custody, this Court directs

the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that he shall appear before the jurisdictional Police Station once every month till conclusion of trial and one of the sureties shall be the immediate family member of the petitioner.

Violation of any of the conditions shall entail cancellation of bail.

9.

Accordingly, the BLAPL stands disposed of.
