This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

It is submitted by the learned counsel for the Petitioner that the present Petitioner is a lady and Government servant. Further it is submitted by the learned counsel for the Petitioner that the brothers of the present Petitioner namely, Hrusikesh Beura and Binod Kumar Beura were apprehended by the Police while they were in possession of contraband brown sugar of 7 gms and 8 gms respectively. It is also contended by the learned counsel for the Petitioner that those two accused persons from whose possession such contraband brown sugar have been recovered have already been released on bail. 5.

Considering the fact that the Petitioner is a lady and Government servant and her name does not find place in the F.I.R., I

// 2 // am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned Special Judge, Jagatsinghpur in C.T.Case No.98 of 2021 arising out of Tirtol P.S.Case No.338 of 2021 within a period of three weeks from today and moves for bail, she shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Special Judge, Jagatsinghpur.
