1. For the reasons stated therein, the application is allowed. Accordingly, delay of 97 days in filing the present appeal is condoned. The Misc. Case is disposed of.

2. It appears that although nearly eight years have elapsed after the disposal of the writ petition in favour of the Respondent by the learned Single Judge on 26th November, 2014 the Respondent has not come forward for implementation of that order. No contempt petition also seems to have been filed. On its part the Appellant has, even without a stay being granted by this Court, not implemented the impugned order. In other words, all around there seems to be a

complete indifference as regards the implementation of order of the learned Single Judge.

3. Even today the present appeal was listed in its own turn without anyone mentioning it for early listing.

4. In the circumstances, the Court sees no reasons why it should entertain the present appeal and it is disposed of as such. As and when the Respondent comes forward seeking implementation of the impugned order of the learned Single Judge, it will be open to the Appellant to revive the present appeal.
