Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 1238 of 2022 arising out of Golanthara P.S. Case No. 197 of 2022, pending on the file of the learned S.D.J.M., Berhampur, for the alleged commission of offence under Sections 342/323/376(1) of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned 3rd Addl. District & Sessions Judge, Berhampur by Order dtd.25.07.2022, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

Considering the tenor thereof and taking into account the Charge Sheet has already been filed on 31.07.2022 as stated by the learned counsel for the petitioner, this Court

directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

The BLAPL thus stands disposed of.
