Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to issue appointment order in his favour against any Class-III/IV post under the Rehabilitation Assistance Rules, 1990 in view of judgment Malaya Nanda Sethy v. State of Odisha, 2022(II) OLR (SC) 1.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation/application to the authority, vide Annexure-3 and the same may be directed to be considered and disposed of taking into consideration the judgment of the apex Court in Malaya Nanda Sethy (supra) within a stipulated time, to which learned State Counsel has raised no objection. 5.
As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the
case, disposes of the writ petition directing the authority to consider the representation/application filed by the petitioner, vide Annexure-3 and pass appropriate order in accordance with law taking into consideration the judgment of the apex Court in Malaya Nanda Sethy(supra) within a period of three months from the date of production of certified copy this order.
