1. This is an application for condonation of delay of 37 days in filing the appeal.

2. For the reasons stated, the application for condonation of delay is allowed. The Misc. Case is disposed of.

3. By the impugned order 50% of the payment by the bhag tenants which was kept in Recurring Deposit and till the disposal of Review Petition No.22 of 2005 or Writ Appeal No.323 of 2013, whichever is earlier.

4. Learned counsel for the Appellant informs the Court that both Review Petition No.22 of 2005 as well as Writ Appeal No.323 of 2013 have been disposed of.

5. In that view of the matter, there will be no issue in releasing the balance 50% payment. In that view of the
