The Petitioner in this CMP seeks to assail the order dated 5th July, 2022 (Annexure-5) passed by learned 1st Additional Civil Judge (Senior Division), Cuttack in C.M.A. No.639 of 2011 (arising out of C.S. No.764 of 2011), whereby an application filed by the Petitioner to represent the Plaintiff as his Power of Attorney and depose in the suit was rejected. 3.

In course of hearing, Mr. Satapathy, learned counsel for the Petitioner submits that interest of justice will be best served, if the Petitioner files an application under Order XXVI Rule 1 C.P.C. to examine the Plaintiff on commission by enclosing relevant documents. He, therefore, prays for withdrawal of the CMP.

In view of the above, the CMP is disposed of as withdrawn.

Urgent certified copy of this order be granted on proper application.
