Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 717 of 2022 arising out of Bhawanipatna P.S. Case No. 258 of 2022, pending on the file of the learned SDJM, Bhawanipatna, for the alleged commission of offence under Sections 417/420/376(1)/294/506 of the I.P.C. 4.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna(I/C), by Order dtd.26.07.2022, the present BLAPL has been filed.

Considering the tenor of the 164 Cr.P.C. statement of the victim and taking into account that the petitioner is in custody since 24.6.2022, this Court directs the petitioner to be

released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The BLAPL thus stands disposed of.
