Heard Mr. B.K. Routray, learned Counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate for the State. 3.
The Petitioner has filed this Writ Petition seeking direction to the Opposite Parties to evict the encroacher from the government land vide Khata No. 927, Plot No. 912 measuring an area of Ac. 0.020 dec. 4.
Mr. A.K. Mishra, learned Additional Government Advocate raised preliminary objection with regard to maintainability of the Writ Petition contending that though prayer has been made to evict the encroacher from the government land, but the so called encroacher has not been made party to the Writ Petition and as such, the Writ Petition suffers from non-joinder of parties and the same is liable to be dismissed. 5.
In view of the above, this Court is not inclined to entertain the Writ Petition since the same suffers from non-joinder of parties. Arun (DR. B.R. SARANGI) JUDGE
