This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for State.

The petitioner is an accused in C.T. Case No.332 of 2022 corresponding to Berhampur P.S. Case No.74 of 2022, pending in the Court of learned S.D.J.M., Nilgiri, under Sections 420/406/294/120-B/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cum-P.O., Designated Court, OPID, Balasore, by order dated 25.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Learned counsel for the petitioner submits that he is not the principal accused in fact his role is limited to being a KIOSK Operator of HDFC Bank.

Learned counsel for the State opposed the prayer for bail.

This Court had perused the statement of one of the victims Susanta Palei, which clearly illustrates the role played by the present petitioner. Hence at this stage when investigation is going on, this Court is not inclined to entertain this bail application at this stage.

It shall be open for the petitioner to move this Court to renew his prayer for bail afresh after filing the final form. 9.

Accordingly the BLAPL stands rejected.
