This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with Rengali P.S. Case No. 93 of 2019 corresponding to T.R. Case No. 38 of 2019 pending on the file of learned Sessions Judge-cum-Judge(SPL) Court Sambalpur, for the alleged commission of offence under Section 20(b)(ii) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr. P.C. by the learned Sessions Judge-cum-Judge(SPL) Court Sambalpur by order dated 19.08.2019, the present BLAPL has been filed.

Considering the nature of allegation and bar Under Section 37 of the NDPS Act and in view of the report of the learned court in seisin over the matter, this Court is not inclined to entertain this BLAPL. Accordingly, the same stands rejected.

The learned court in seisin over the matter is called upon to expedite the trial since the petitioner is stated to be custody since 2019.
