The present Contempt Petition has been filed for the alleged disobedience of the order dated 16th July, 2019 passed in W.P.(C) No.10137 of 2019, whereby the authorities were directed to decide the representation of the petitioner for refund of the excess royalty paid by the petitioner-Company. 2.

Mr.

Mohanty, learned Additional Standing Counsel, at the time of hearing has placed on record a memo dated 15th November, 2022 issued by the Chief Engineer (DPI & Roads), Odisha directing the Executive Engineer, Bolangir (R & B) Division for taking immediate action for refund of the excess royalty within 15 days i.e. 30th November, 2022. Copy the memo has retained on record.

// 2 // In view of the aforesaid direction issued by the Chief Engineer, (DPI & Roads), Odisha, learned counsel for the petitioner concedes that the present Contempt Petition can be disposed of as infructuous. 3.

In view of the above, the present Contempt Petition stands disposed of as infructuous.
