Madhumita Baliarsingh v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.19331 of 2022 Madhumita Baliarsingh & Anr.
....
Petitioner(s) Mr. T. Dash, Advocate -versusState of Odisha & Ors.
....
Opposite Party(s) Mr. U.K. Sahoo, Addl. Standing Counsel
CORAM:
JUSTICE BISWANATH RATH
ORDER
03.08.2022 01.
1.
In course of hearing it is alleged by the learned State Counsel Order No.
that in the first round of litigation the Petitioners have obtained an order from this Court on misrepresentation of fact to the extent of pendency of objection of the Petitioners at the relevant point of time, which is not correct. As a matter fact there is no objection pending at the instance of the Petitioners before the competent authority. There is also no filing of copy of any such objection even. Learned counsel for the Petitioners also fails to produce copy of such objection when he repeatedly submits that the Petitioners have already made representation. This Court, therefore, is not inclined to entertain the writ petition at this stage. However considering the request made by the learned counsel for Petitioners, this Court permits the Petitioners to withdraw this writ petition with liberty to file a fresh writ petition enclosing the objection of the Petitioners, if any, existing.

The writ petition is, accordingly, disposed of as withdrawn, but with liberty as prayed for.
