This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

The petitioner is accused in Baripada Town P.S. Case No.916 of 2021 arising out of C.T. Case No.129 of 2021, pending before the learned ADJ & Sessions Judge-cum-P.O., Special Court under POCSO Act, Mayurbhanj, Baripada, under Sections 417/376(2)(n)/294/506/34 of IPC read with Section 6 of the POCSO Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Court under POCSO Act, Mayurbhanj, Baripada, by order dated 18.07.2022 in the aforementioned case, the present BLAPL has been filed. 6.

Perused the 164 Cr.P.C. statement.

Considering the tenor thereof and taking into account that the petitioner is in custody since 28.10.2021 and charge-sheet has

already been filed on 23.12.2021, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
