This matter is taken up through hybrid mode.

Heard Mr.Lalit Sahu, learned counsel for the petitioners and Mr. D.K.Mohanty, learned Addl. Standing Counsel. 3.

According to Mr. Sahu, the grievance of the petitioners is that though they have already received compensation to the tune of Rs.3,09,031/-, however, they are yet to receive the ex-gratia payments to which they are otherwise entitled to. He further submits that though the ex-gratia compensation has been released in favour of the other similarly situated persons, whereas the case of the petitioners has been ignored.

During course of hearing, Mr. Sahu, learned counsel for the petitioners submits that liberty may be given to the petitioners to file representation before the opp. party No.4-Special Land Acquisition and Rehabilitation & Resettlement Officer, Lower Suktel Irrigation Project, Balangir for redressal of their grievances and further prays that the opp. party No.4 be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to file separate individual representation before the opp. party No.4- Special Land Acquisition and Rehabilitation & Resettlement Officer, Lower Suktel Irrigation Project, Balangir, within a period of two weeks along with a copy of this order by Registered Posts. In the event, such representations are received by the above noted officer, he/she is directed to take a decision on such representation/s in accordance with law, within a period of three months from the date of receipt of the certified copy of this order and communicate the result of such decision to the petitioners. 6.

With the above observation and direction, the writ petition is disposed of.
